1. Agreement to terms
These terms form a binding agreement between you and Homicity. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers to that organisation.
If you do not agree to these terms, you must not access or use the Services.
2. The services
Homicity provides real estate data, mapping and market intelligence through the Neighbourly.io API, a portfolio of owned platforms, and professional solutions. We may add, change or remove features from time to time.
3. Accounts and registration
You may need an account and API credentials to use parts of the Services. You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly of any unauthorised use.
4. Acceptable use
You agree not to:
- Use the Services to violate any law or the rights of others.
- Reverse engineer, resell or redistribute the data or Services except as expressly permitted.
- Attempt to circumvent rate limits, security controls or usage restrictions.
- Use the Services to build a competing data product from our data.
5. API usage and limits
Access to the Neighbourly.io API is subject to the plan you select, including rate limits and usage volumes. We may throttle, suspend or limit access to protect the integrity and availability of the Services.
6. Fees and payment
Paid Services are billed according to the plan and pricing agreed at sign-up. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.
7. Intellectual property
The Services, including all software, data compilations, trademarks and content, are owned by Homicity or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Services in accordance with these terms.
8. Data and content
You retain rights to data you submit to the Services. You grant Homicity a licence to process that data to provide and improve the Services. Our handling of personal data is described in our Privacy Policy.
9. Disclaimers
The Services and all data are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the data is accurate, complete or fit for a particular purpose, and it should not be relied upon as the sole basis for any financial, legal or property decision.
10. Limitation of liability
To the fullest extent permitted by law, Homicity will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or goodwill arising from your use of the Services. Our total liability is limited to the amounts you paid to us in the twelve months preceding the claim.
11. Termination
We may suspend or terminate your access to the Services if you breach these terms or use the Services in a way that risks harm to us or others. You may stop using the Services at any time.
12. Changes to these terms
We may update these terms from time to time. If we make material changes, we will provide reasonable notice. Your continued use of the Services after changes take effect constitutes acceptance.
13. Governing law
These terms are governed by the laws of the jurisdiction in which Homicity is established, without regard to conflict-of-laws principles.
